Restoring a Patent

In case of termination of a patent right due to no timely renewal or abandonment of right, a request can be submitted within 18 months of the expiry date of the protection right for restoring the patent or the application.

Filing an application

You amy submit the application for restoring a patent or an application for a patent (form Π.14), by hand/post, accompanied by the following:

  • application for restoring a patent right or application (form Π.15)
  • application for renewing a patent or an application for granting a patent (form Π.13)
  • form for authorising an agent (form Π.8) in case where a power of attorney covering the said procedure has not already been filed
  • the fee of one hundred and twenty euros (€120) payable in cash, by cheque, via an account maintained with the Department of the Registrar of Companies and Intellectual Property or via bank transfer.

You are advised to refer to the main criteria of review so as to acquire a better understanding what is required and to facilitate the process further.

Provided that the Intellectual Property Section is satisfied that all, relevant to the circumstances, legal requirements have been met, he will proceed with filing the restoration and updating the patents register.
